Welcome to Clavcart. These Terms and Conditions govern your access to and use of our website, mobile applications, marketplace, seller services, delivery services, affiliate program, advertising services, payment facilities, communication features, customer-support services, and all other services made available through the platform.
Clavcart operates as a digital marketplace that connects buyers, sellers, delivery partners, affiliates, advertisers, and other participants in an integrated e-commerce environment. These Terms establish the rules governing your participation in that marketplace and define the rights and responsibilities of both users and the platform.
By accessing, browsing, registering for an account, listing products, purchasing products, accepting deliveries, participating in the affiliate program, purchasing advertising services, or otherwise using any part of the platform, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you should not use the platform.
These Terms should be read together with our Privacy Policy, Cookie Policy, Purchasing Policy, Return and Refund Policy, Seller Terms, Affiliate Terms, Advertising Terms, and any other policies displayed on the platform.

The platform may add, modify, suspend, or discontinue features from time to time as the marketplace evolves.
Unless expressly stated otherwise, the platform operates primarily as a marketplace and technology intermediary connecting buyers with independent sellers.
Sellers are responsible for the products they list, their descriptions, pricing, stock availability, fulfillment, applicable warranties, and compliance with applicable laws and marketplace policies.
The platform does not necessarily manufacture, own, inspect, or directly supply every product listed on the marketplace.
The existence of a product listing does not constitute an endorsement or guarantee by the platform that the product is suitable for a particular purpose.
Where the platform itself is the seller or supplier of a particular product, the applicable transaction will be identified accordingly.
Sellers must provide accurate information when registering and must complete any verification process required by the platform.
The platform may request identity documents, business registration information, payment information, tax information, contact information, product information, or other information reasonably necessary to verify and operate a seller account.
Sellers are responsible for keeping their account information accurate and current.
The platform may suspend or restrict seller accounts where information is inaccurate, incomplete, fraudulent, misleading, or otherwise inconsistent with marketplace requirements.
Sellers are responsible for ensuring that their products comply with applicable laws and marketplace policies.
Sellers must provide accurate product descriptions, photographs, specifications, pricing, stock information, shipping information, warranties, and other relevant information.
Sellers must not intentionally misrepresent products, manipulate reviews, create fraudulent listings, sell counterfeit goods, list prohibited products, or engage in deceptive practices.
Sellers must fulfill accepted orders within the applicable timeframe and provide products that substantially correspond with their listings.
Sellers are also responsible for complying with applicable tax, licensing, consumer-protection, product-safety, intellectual-property, and other legal requirements relevant to their business.
The platform allows sellers to create product listings containing information about their products.
Listings must be truthful, accurate, complete, and not misleading.
Sellers must not use misleading photographs, false specifications, deceptive prices, fake scarcity claims, counterfeit branding, or other information intended to mislead customers.
The platform may review, modify, restrict, suspend, or remove listings that violate marketplace rules or applicable law.
Sellers generally determine the prices of their products.
Prices displayed on the platform may change at any time before an order is submitted.
The final purchase price applicable to a transaction will be displayed during checkout, together with applicable delivery charges, taxes, fees, discounts, or other mandatory costs where required.
The platform reserves the right to correct obvious technical or pricing errors and take appropriate action concerning orders affected by such errors, subject to applicable law.
Buyers may browse products, add products to their shopping carts, select available options, provide delivery information, choose a payment method, and submit orders through the platform.
Before submitting an order, buyers should review the product information, seller details, quantity, selected options, delivery address, delivery method, applicable charges, and total price.
Purchases are subject to the Purchasing Policy and applicable seller terms.
Submitting an order constitutes an offer to purchase the selected products.
An order may be subject to payment authorization, product availability, seller acceptance, fraud checks, technical verification, and other applicable conditions.
The platform may provide an electronic confirmation after receiving an order.
An order confirmation does not necessarily guarantee that the seller will be able to fulfill the order.
Where an order cannot be fulfilled, the platform or seller may cancel the order and provide any applicable refund in accordance with the relevant policies and applicable law.
Payments must be made through the payment methods supported by the platform.
Payment processing may be performed by independent payment service providers.
Users must provide accurate payment information and must not use payment methods that they are not authorized to use.
The platform may delay, restrict, or cancel transactions where payment authorization fails or where there are reasonable indications of fraud, unauthorized activity, or other prohibited conduct.
Users must not attempt to circumvent platform payment systems where doing so violates marketplace rules.
Orders may be delivered by sellers, independent delivery partners, logistics companies, or other fulfillment providers.
Estimated delivery times are provided for convenience and are not necessarily guaranteed unless expressly stated otherwise.
Delivery times may be affected by product availability, destination, weather, transportation, public holidays, customs, operational conditions, or other circumstances.
Customers are responsible for providing accurate delivery information and being reasonably available to receive their orders.
Delivery partners are independent participants in the marketplace unless otherwise stated.
Delivery partners are responsible for completing assigned deliveries professionally, safely, and in accordance with applicable delivery requirements.
They must protect customer information and use it only for legitimate delivery purposes.
Delivery partners may be required to complete identity, vehicle, licensing, background, or other verification procedures before accessing delivery services.
Returns, refunds, exchanges, and cancellations are governed by the platform's Purchasing Policy and Return and Refund Policy, together with applicable seller terms and consumer-protection laws.
Certain products may have special return conditions or exclusions where permitted by law.
Nothing in these Terms is intended to remove or restrict any mandatory consumer right that cannot lawfully be excluded.
Buyers must provide accurate account, payment, and delivery information.
Buyers must use the marketplace honestly and lawfully.
Buyers must not submit fraudulent orders, manipulate promotions, abuse refund systems, submit false complaints, create fake accounts for promotional benefits, manipulate ratings or reviews, or otherwise abuse marketplace services.
Buyers must inspect products and report legitimate problems through the appropriate support or dispute process.
The marketplace may allow customers to review products, sellers, and delivery experiences.
Reviews must represent genuine experiences.
Users must not submit fake reviews, reviews in exchange for undisclosed compensation, malicious reviews, fraudulent ratings, defamatory content, threats, personal information belonging to others, or content that violates applicable law.
The platform may remove or restrict content that violates its policies.
The platform does not guarantee that every review represents the views or experiences of the platform.
The platform provides an affiliate marketing program through which approved affiliates may promote eligible products.
Affiliates may receive unique tracking links, promotional codes, analytics, and commission information.
Affiliate participation is subject to additional Affiliate Program Terms.
Affiliates must make appropriate disclosures about commercial relationships where required by applicable law and must not engage in misleading advertising, false claims, spam, fraudulent referrals, cookie manipulation, self-referrals where prohibited, or other abusive practices.
The platform may suspend affiliate accounts and withhold or reverse commissions associated with fraudulent, cancelled, refunded, or otherwise ineligible transactions where permitted under the Affiliate Terms.
The marketplace provides advertising services through which sellers, brands, and other businesses can promote products or services.
Advertising placements may include sponsored listings, promoted products, banners, search advertisements, category placements, promotional campaigns, and other advertising formats.
Advertisers are responsible for ensuring that advertising content is accurate, lawful, and compliant with applicable advertising standards.
The platform may reject, remove, modify, suspend, or discontinue advertising content that violates marketplace policies or applicable law.
Advertising performance may depend on factors such as customer activity, competition, product availability, budget, targeting, and marketplace conditions. The platform does not guarantee a specific number of impressions, clicks, leads, or sales unless expressly agreed in writing.
Users must not use the platform to:
Commit or facilitate fraud or other unlawful activity.
Sell or promote prohibited, illegal, counterfeit, stolen, or unauthorized products.
Create false or misleading product listings.
Impersonate another person or business.
Create fraudulent or duplicate accounts for abusive purposes.
Manipulate product rankings, reviews, ratings, or marketplace metrics.
Use automated systems to scrape, crawl, overload, or improperly access the platform.
Attempt to gain unauthorized access to accounts, systems, databases, or networks.
Introduce malware, viruses, malicious code, or other harmful technology.
Circumvent security or authentication mechanisms.
Abuse promotions, discounts, refunds, returns, or referral programs.
Use customer information obtained through the marketplace for unauthorized purposes.
Harass, threaten, defame, or abuse other users.
Circumvent marketplace payment systems in violation of platform rules.
Use the platform in a manner that violates applicable laws or regulations.
The platform may take appropriate action when prohibited activity is detected.
The platform and its underlying technology, design, software, trademarks, logos, graphics, databases, content, interfaces, and other intellectual property are owned by or licensed to the platform and are protected by applicable intellectual-property laws.
Users may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit platform intellectual property without appropriate authorization.
Sellers retain ownership of their original product content and intellectual property, subject to the rights granted to the platform under these Terms.
When sellers upload photographs, descriptions, logos, product information, videos, trademarks, or other content to the marketplace, they grant the platform a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, format, modify where technically necessary, and use that content for operating, promoting, marketing, and improving the marketplace.
This license continues for as long as reasonably necessary for the platform to provide services relating to the relevant content and may continue where necessary for archival, legal, security, dispute-resolution, or other legitimate purposes.
Sellers represent that they have the necessary rights to provide such content.
Users may submit reviews, comments, photographs, questions, messages, feedback, and other content.
Users remain responsible for the content they submit.
By submitting content, users grant the platform the rights reasonably necessary to store, display, distribute, moderate, and use that content for operating and improving the marketplace.
Users must not submit content that infringes another person's intellectual-property rights, privacy rights, or other legal rights.
Our collection and processing of personal information is governed by our Privacy Policy.
By using the platform, users acknowledge that personal information may be processed as necessary to provide marketplace services, including account management, payments, order fulfillment, delivery, customer support, fraud prevention, analytics, advertising, affiliate attribution, and other legitimate platform activities.
The platform applies appropriate privacy and security measures in accordance with applicable laws.
For a Zimbabwe-based operation, the platform's privacy practices should be aligned with applicable data-protection requirements, including the Cyber and Data Protection Act where applicable.
The platform uses cookies and similar technologies to provide essential functionality, maintain accounts and shopping carts, improve performance, personalize experiences, support advertising, measure marketing campaigns, and facilitate affiliate tracking.
Cookie use is governed by our Cookie Policy.
Where applicable law requires consent for non-essential cookies or tracking technologies, users will be provided with appropriate choices.
The platform may integrate third-party services including payment providers, delivery systems, analytics services, advertising platforms, communication services, identity-verification providers, cloud infrastructure, and other technology services.
Third-party services may operate under their own terms and privacy policies.
The platform is not responsible for the independent policies or practices of third parties except to the extent required by applicable law or contractual obligations.
The marketplace may contain links to external websites or services.
These links are provided for convenience and do not necessarily constitute an endorsement.
The platform does not control external websites and is not responsible for their content, security, availability, privacy practices, or terms.
Users should review the terms and privacy policies of external services before using them.
We aim to keep the marketplace available and reliable but do not guarantee that the platform will always be uninterrupted, error-free, or available.
The platform may occasionally be unavailable because of maintenance, upgrades, technical problems, security incidents, network failures, third-party service interruptions, or other circumstances.
We may temporarily suspend access to certain features where necessary to maintain security, reliability, or compliance.
We may suspend, restrict, or terminate an account where we reasonably believe that the user has violated these Terms, marketplace policies, applicable law, engaged in fraud or abuse, created a security risk, or otherwise acted in a manner that may harm the marketplace or its users.
Users may also request closure of their accounts, subject to outstanding transactions, legal obligations, dispute processes, financial obligations, and other applicable requirements.
Termination does not automatically eliminate obligations that arose before termination.
Certain provisions of these Terms may continue after account termination where their nature requires continued application.
The platform may investigate suspected violations of these Terms, marketplace policies, fraud, abuse, unauthorized activity, intellectual-property infringement, security incidents, or other misconduct.
Users agree to reasonably cooperate with legitimate investigations.
The platform may preserve relevant information where reasonably necessary for security, legal compliance, dispute resolution, fraud prevention, or enforcement of these Terms.
The platform provides mechanisms through which buyers and sellers can attempt to resolve disputes.
Where a dispute arises, the platform may review relevant information including order records, payment information, communications, product information, delivery records, photographs, tracking information, and other evidence.
The platform may determine an appropriate marketplace resolution based on the available evidence and applicable policies.
The platform's dispute-resolution process does not remove any rights that a party may have under mandatory applicable law.
The marketplace is designed to facilitate transactions between users. Unless expressly stated otherwise, the platform does not guarantee that every seller, product, listing, advertisement, review, delivery partner, or user will meet a particular standard.
The platform does not guarantee that products will always be available, that sellers will fulfill every order, or that product information supplied by independent sellers will always be error-free.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Sellers are responsible for ensuring that products offered through the marketplace comply with applicable product-safety laws and requirements.
The platform may remove products that are reported or identified as unsafe, prohibited, counterfeit, recalled, or otherwise unsuitable for sale.
Users should report suspected unsafe or prohibited products through the appropriate marketplace reporting channels.
To the extent permitted by applicable law, a user may be responsible for losses, claims, damages, liabilities, costs, and reasonable expenses arising from the user's unlawful conduct, violation of these Terms, infringement of another person's rights, fraudulent activity, or misuse of the platform.
This provision does not apply to the extent that applicable law prohibits such an obligation.
If the platform does not immediately enforce a provision of these Terms, that does not mean the platform has permanently waived its right to enforce that provision.
A waiver must be expressly made by an authorized representative of the platform.
We may modify, improve, expand, reduce, or discontinue features of the marketplace at any time.
Where a change materially affects users' contractual rights or obligations and applicable law requires notice, appropriate notice will be provided.
Continued use of the platform after applicable changes take effect may constitute acceptance of the updated Terms where permitted by law.
We may update these Terms and Conditions from time to time.
When significant changes are made, we may provide notice through the website, application, email, account notifications, or another appropriate communication method.
The "Last Updated" date at the beginning of these Terms indicates when they were most recently revised.
Users should periodically review the Terms to remain informed about the rules governing the marketplace.
By using the marketplace, users consent to receive electronic communications relating to their accounts and transactions.
These communications may include order confirmations, payment notifications, delivery updates, security alerts, customer-support communications, policy updates, and other service-related notices.
Where permitted by law, electronic records and communications may satisfy requirements for written communications.
Zimbabwe's Consumer Protection Act specifically addresses electronic transactions and requires certain transaction information and terms to be made available electronically to consumers.
The platform may maintain electronic records of accounts, orders, payments, communications, listings, deliveries, reviews, disputes, and other marketplace activities.
These records may be used to operate the marketplace, provide customer support, resolve disputes, prevent fraud, comply with legal requirements, and maintain transaction histories.
Users should retain their own copies of important transaction records where appropriate.
Where the platform is required to provide notice to a user, notice may be delivered through email, account notifications, platform announcements, SMS, application notifications, or other legally permitted communication methods.
Users are responsible for maintaining accurate contact information.
These Terms shall be governed by and interpreted in accordance with the laws applicable to the legal entity operating the marketplace, unless applicable law requires otherwise.
For a platform operated by a Zimbabwean entity, the governing-law provision should be finalized to reflect the applicable laws of Zimbabwe and the jurisdiction in which the company is legally established.
Nothing in these Terms is intended to deprive consumers of mandatory rights or protections available to them under applicable consumer-protection laws.
Where a dispute arises between a user and the platform, the parties should first attempt to resolve the matter through the platform's customer-support or formal complaint process.
Where appropriate, disputes may subsequently be referred to mediation, arbitration, or a competent court in accordance with applicable law and any applicable dispute-resolution agreement.
Nothing in this section prevents a consumer from exercising a mandatory right to access a competent regulatory body, consumer-protection authority, alternative dispute-resolution mechanism, or court where such right cannot lawfully be excluded.
Zimbabwe's Consumer Protection Act provides for consumer dispute mechanisms and the Consumer Protection Commission framework, which should be considered when finalizing the platform's dispute-resolution procedures.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally possible.
The remaining provisions will continue to apply.
These Terms, together with the Privacy Policy, Cookie Policy, Purchasing Policy, Return and Refund Policy, Seller Terms, Affiliate Terms, Advertising Terms, and other applicable policies, constitute the terms governing your use of the marketplace.
Where a specific service has separate terms, those terms apply in addition to these Terms for that service.

Buyers gain access to a wide range of products and convenient digital purchasing tools. Sellers gain access to a broader customer base and the infrastructure required to operate an online storefront. Delivery partners gain access to delivery opportunities and organized order management. Affiliates gain opportunities to earn commissions by promoting products. Advertisers gain access to digital marketing opportunities and marketplace audiences.
These Terms exist to provide a clear framework for that ecosystem and to establish expectations for responsible participation.
Our objective is to maintain a marketplace that is transparent, secure, commercially useful, and respectful of the rights of everyone who uses it. By following these Terms, users contribute to a marketplace where businesses can grow, customers can shop with greater confidence, and digital commerce can operate efficiently and responsibly.
